NOTIFICATIONS


The Government of Bihar has notified “The Bihar Occupational Safety, Health and Working Conditions Rules, 2025” vide notification dated 18th December 2025, issued by the Labour Resources and Migrant Workers Welfare Department under the Occupational Safety, Health and Working Conditions Code, 2020.
These Rules supersede multiple earlier State Rules, including the Bihar Factories Rules, Contract Labour Rules, Building and Construction Workers Rules, Inter-State Migrant Workmen Rules, Motor Transport Workers Rules, and Beedi and Cigar Workers Rules. Accordingly, all establishments operating in Bihar must ensure compliance strictly as per the new consolidated framework.

Key Compliance Highlights:
1. Mandatory Online Registration

All establishments must register electronically in Form-I on the designated portal.
Registration certificate (Form-II) will be issued within 7 days, failing which deemed registration applies.
Any change in ownership, management, or particulars must be updated within 30 days.

2. Appointment Letter and Identity Card
Appointment letters in the prescribed format must be issued to all employees.
Identity cards are mandatory for all workers (except daily wage workers).

3.Registers, Records and Returns

Maintain statutory registers electronically for workers, wages, overtime, leave, accidents, etc.
Preserve records for 10 years.
Submit Annual Return (Form-IX) on or before 1st February of the succeeding year.

4.Working Hours and Overtime
Maximum working hours: 48 hours per week.
Overtime capped at 144 hours per quarter, subject to employee consent.
Weekly rest day and spread-over provisions must be followed.

5.Health and Safety Obligations
Annual medical examination for workers above 45 years of age.
Constitution of Safety Committee and appointment of Safety Officers where applicable.
Maintain emergency plans, accident registers, and safety inspection records.

6. Accident, Dangerous Occurrence and Disease Reporting
Report accidents and dangerous occurrences within 24 hours in prescribed forms.
Immediate intimation to Inspector-cum-Facilitator, District Authorities, and other officials.

7. Late Fees and Penalties
Late registration attracts graded late fees based on employee strength and delay period.
Non-compliance may lead to inspections, improvement notices, penalties, and prosecution under the Code.

The Government of Puducherry, vide G.O.Ms.No.25/LAB/AIL/G/2025 dated 15 December 2025, has issued an order under Section 27 of the Occupational Safety, Health and Working Conditions Code, 2020 (Central Act 37 of 2020) regarding the total number of hours of overtime permissible in establishments across the Union Territory of Puducherry.
Key Provisions on Overtime:
1. Eligibility and Rate of Pay:
o If a worker works for more than 8 hours in a day or 48 hours in a week, subject to their consent, they shall be entitled to overtime wages at twice the ordinary rate of wages, payable at the end of each wage period.
2. Calculation of Overtime:
o A fraction of an hour between 15 to 30 minutes shall be counted as 30 minutes, and more than 30 minutes shall be rounded up to one hour.
o For monthly-paid workers, daily wages = 1/26th of monthly wages.
3. Spread Over:
o The spread over shall not exceed 12 hours in any one day, except under specific circumstances such as:
? Urgent repairs
? Preparatory or complementary work
? Work requiring continuous operation for technical reasons
? Processes dependent on natural forces
? Engine rooms, boiler houses, power plants
? Loading/unloading of railway wagons or trucks
? Exceptional press of work
? Work notified as of national importance
4. Quarterly Limit:
o No worker shall be allowed to work overtime exceeding 144 hours in any quarter of a year.

o Women employed in manufacturing processes where dust, fumes, or other impurities are emitted must be provided with suitable respirators, nose masks, etc.
2. Safety Apparel Near Machinery:
o No woman worker shall work near machinery in motion without wearing adequate safety apparel to prevent bodily injury.
3. Provision for Sitting:
o Suitable arrangements for sitting must be provided and maintained separately for women required to work in a standing position, allowing them to rest when possible.
4. Ergonomic Safety:
o As far as practicable, women should not be engaged in workplaces involving poor ergonomics detrimental to their safety and health.
5. Hazard Information Dissemination:
o Employers handling hazardous processes must provide information on dangers, physical and health hazards related to exposure, handling, transportation, and storage.
o This information must be communicated in local vernacular language and English.
This notification emphasizes the employer’s responsibility to ensure adequate safety measures for women in hazardous operations.

Key Conditions for Night Shift Employment of Women:
1. Consent Requirement:
o Prior consent of women employees must be obtained for employment during night hours (before 6:00 a.m. and beyond 7:00 p.m.).
2. Maternity Benefits Compliance:
o No woman shall be employed in violation of provisions under the Code on Social Security, 2020 related to maternity benefits.
3. Transportation Facilities:
o Employers must provide adequate pick-up and drop transportation for women employees to and from their residence.
4. Workplace Lighting:
o The workplace, including passages to toilets, washrooms, drinking water, and entry/exit points, must be well-lit.
5. Proximity of Facilities:
o Toilets, washrooms, and drinking water facilities must be in close proximity to the workplace.
6. Safe and Healthy Working Conditions:
o Employers must ensure safe, secure, and healthy conditions so that women are not disadvantaged in connection with their employment.
7. Special Provision for Mines:
o For women employed in mines below ground, at least three women employees must be on duty at any place and time.
8. Compliance with Sexual Harassment Act:
o All establishments must comply with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
