NOTIFICATIONS


The Government of Bihar, vide No. 1/Code on Wages 10-01/2021, has released the Code on Wages (Bihar) Rules, 2025. Please refer to the attached notification for complete details.

As per the notification, the State Government has exercised the powers under Section 67 of the Code on Wages, 2019, and has superseded the earlier Bihar Payment of Wages Rules, 1937 and the Bihar Minimum Wages Rules, 1951, which stood repealed under Section 69 of the Code.

The key highlights of the attached rules include:

Short title, extent, and commencement: The rules are titled Code on Wages (Bihar) Rules, 2025 and extend to the entire State of Bihar, effective from the date of publication in the Official Gazette.

Revised minimum wage calculation norms: Based on standard working-class family criteria, caloric intake, clothing, housing rent, fuel and communication expenses, and education/medical contingencies.

Skill categorization: Employees must now be classified as Unskilled, Semi-Skilled, Skilled, or Highly Skilled as defined in the rules.

Working hours: Maximum 48 hours per week with specific limits for 4-day, 5-day, or 6-day weeks, including overtime and rest intervals.

Weekly rest day norms and substituted rest day provisions.

Overtime restrictions: Not more than 144 hours in any quarter; written consent required.

Wage payment, deductions, and fines: Detailed process for approvals, intimation, and employee communication.

Mandatory registers and formats (Form I to Form IX): Employee Register, Wage Register, Muster Roll, Wage Slip, Nomination Form, etc., to be maintained electronically or physically.

Nomination requirements: Employees must file nomination in Form VII for settlement of dues.

Contractor employees: Principal employer responsibility in case of non-payment of wages or minimum bonus by contractor.

Annual return: Mandatory electronic filing under the prescribed format.
