ORDER :

Whereas the State Government  are satisfied that the leave rules applicable to the workers of the factory, "Tamil Nadu Co-operative Marketing Federation Limited, Chennai-18 are not less favourable than these for which Chapter VIII of the Factories Act 1948, (Central Act LXIII of 1948) makes provision.

2. Now, therefore, in exercise of the powers conferred by section 84 of the said Act, the Governor of Tamil  Nadu hereby exempts the said "Tamil Nadu Cooperative Marketing Federation Limited, Chennai-18" from the provision of section 79 to 82 of the Factories Act subject to the conditions that if any of the provisions made in the leave rules of the said Tamil Nadu Co-operative Marketing Federation Limited,Chennai-18 is not observed this order shall be deemed to have been revoked.

ORDER :

Section 64(2)(k) of Factories Act, 1948 stipulates that the State Government may make rules in respect of adult workers engaged in any work, which is notified by the State Government in the Official Gazette as a work of National Importance providing for exemption from the provisions of sections 51, 52, 55 & 56. Accordingly, rules were framed by the State Government and rule 84 of Tamil Nadu Factories Rules 1950, provides for such exemption for these factories prescribing the limits to work inclusive of overtime as in sub-section 4 or section 64. Section 64(4) states that (i) the total no. of hours of work in any day shall not exceed ten; (ii) the spread over, inclusive of intervals for rest, shall not exceed twelve hours in any one day (iii) the total no. of hours in a week including overtime shall not exceed sixty and (iv) the total no. of hours of overtime shall not exceed fifty for any quarter.

2. The General Manager, Heavy Vehicles, Factory, Avadi, Chennai has requested the Government that Works in Heavy Vehicles Factory, Avadi, Chennai may be notified as "Works of National Importance" under Factories Act 1948 so that the factory can meet the statutory requirements and also produce and supply the Fighting Vehicles (Tanks) to the Indian Army against their indent without causing any delay.

3. The Chief Inspector of Factories has recommended that the Heavy Vehicles Factory, Avadi, Chennai may be notified under Section 64(2)(k) of the Factories Act, 1948 as works of national importance.

4. The Government after careful examination accept the recommendation of the Chief Inspector of Factories for notifying all the works carried on in the Heavy Vehicles Factory, Avadi, Chennai, as works of 'National Importance".

5. The appended Notification will be published in the Tamil Nadu Government Gazette both in English and Tamil.

6. The Secretary to Government, Tamil Development Culture (Translations) and Religious Endowment Department is requested to send the Tamil version of the Notification direct to the Works Manager, Government Central Press, Chennai-79 for publication in the Tamil Nadu Government Gazette.

NOTIFICATION

In exercise of the powers conferred by clause (k) of sub-section (2) of section 64 of the Factories Act, 1948, (Central Act 63 of 1948) the Governor of Tamil Nadu hereby notifies that all works carried on in the Heavy Vehicles Factory, Avadi, Chennai, Government of India, Ministry of Defence, as a work of National Importance for the purpose of the said clause.
