 All Provisions of the Delhi Shops and Establishment Act, 1954, subject to the following Conditions :-
i)
Overtime wages would be paid to eligible employees in accordance with the provisions of the Delhi Shops and Establishment Act, 1954.
ii)
Employees working on National Holidays shall be given overtime at double the rates of normal wages and compensatory leave in lieu thereof.
iii)
If the notified weekly close-day is not followed, weekly off day will be allowed to employees in rotation.
iv)
Shift working, if any, shall be by rotation so as to ensure that no employee is forced to work in night shift only.
v)
The employer shall ensure security and provide transportation from the residence and back to woman employee if they are employed dung the hours prohibited under section 14 of the Act.
vi)
A copy of this notification shall be prominently displayed at the business premises.

Section 15 and section 16 subject to the following conditions, with effect from 15th September 2004:-
(i)
unless otherwise previously exempted, the shops shall not remain open beyond 11.00 p.m.
(ii)
overtime wages shall be paid to eligible employees at double the normal rate as provided in section 8.
(iii)
shift working, if any, shall be in such a way that neither any employee is forced to work in night shift only, nor over lapping of shifts is permitted;
(iv)
If a shop remains open on all seven days of the week, weekly off to employees shall be given in rotation and the employer shall display Form 'J' as prescribed in the rules.
(v)
The employees working on a National Holiday shall be given a compensatory holiday in addition to over time wages, in lieu thereof.
(vi)
No woman shall be allowed or required to work in any shop, during the hours prohibited under section 14, unless otherwise exempted.
(vii)
Unless otherwise exempted, the employer shall comply with all other provisions of the Act;
(viii)
The employers and market associations will be responsible for the compliance of' the conditions on which the exemption is granted and in case of violations detected during inspections, the Government would take action against the employer, as prescribed in the Act".
