ABOUT THE ACT

Objectives:

The Employment Exchanges Act aims to provide for compulsory notification of vacancies to employment exchanges.The Act stipulates that every establishment in public sector in that State or area, before filling up any vacancy in any employment in establishment, notify that vacancy to such Employment Exchanges as may be prescribed.

Applicability

The Employment Exchanges Act extends to the whole of India and it has been implemented in all the States in the country. The act applies to all establishments in the public sector and to establishments in the private sector ordinarily employing more than 25 employees. However the Act does not apply in relation to vacancies in any employment in agriculture, domestic services, unskilled office work, any employment connected with the staff of Parliament and any employment where the total duration of work is less than 3 months. Unless the Central Government otherwise directs by notification in the Official Gazette in this behalf, this Act shall also not apply in relation to (a) vacancies which are proposed to be filled through promotion or by absorption of surplus staff of any branch or department of the same establishment or on the result of any examination conducted or interview held by, or on the recommendation of, any independent agency, such as the Union or a State Public Service Commission and the like (b) Vacancies which carry a remuneration less than 60 rupees in a month.
